However, the following requirements are mandatory:
- Girl must cross 18 years and boy must cross 21 years.
- They must not be within prohibited relationship.
- They shall not have a spouse. Marrying again during the subsistence of previous marriage is illegal.
- If one belongs to Hindu, Muslim, etc. and if he/she wanted to marry a person from different religion, the marriage must be performed under Special Marriage Act only. Otherwise marry has no value in the eye of law.
- If both belong to same religion, they can marry as per their customs and rites or under Special Marriage Act.
The Hon'ble Supreme Court of India a year ago declared that man and woman living forlong as husband and wife shall be treated as husband and wife though there is no formal marriage.
